Lions Gate Realty is a marketplace platform only. We do not own, manage, operate, inspect, or control any property listed on this platform. Lions Gate Realty accepts no responsibility or liability of any kind for property damage, personal injury, illness, death, theft, financial loss, or any other harm arising from a stay booked through this platform. By using this platform you acknowledge and unconditionally accept these limitations.
Lions Gate Realty ("Lions Gate Realty", "we", "us", "our") operates an online marketplace at lionsgaterealty.ca that connects property owners and managers ("Hosts") with people seeking short-term accommodation ("Guests"). These Terms govern your use of our platform as either a Guest, Host, or visitor.
Lions Gate Realty is operated by a licensed real estate professional in British Columbia. Vacation rental bookings made through this platform are not real estate transactions and are not governed by the Real Estate Services Act (BC).
Lions Gate Realty is a technology marketplace platform only. We are not a property owner, landlord, property manager, rental agency, travel agency, or insurer. We do not own, control, offer, manage, or supply any accommodation listed on the platform.
When a booking is made, the contract of accommodation is formed directly and exclusively between the Guest and the Host. Lions Gate Realty is not a party to that contract. We have no control over and assume no responsibility for the existence, quality, safety, legality, fitness, or any other aspect of any listing.
Hosts are independent contractors. They are not employees, agents, partners, or joint venturers of Lions Gate Realty.
Lions Gate Realty does not conduct background checks on Hosts or Guests, does not verify the identity of users beyond email confirmation, does not inspect properties, and makes no representation that any Host or Guest is who they claim to be.
You must be at least 19 years of age (the age of majority in British Columbia) to create an account, make a booking, or list a property. By registering, you represent and warrant that you meet this requirement.
You agree to provide accurate, current, and complete information at all times. Providing false information is grounds for immediate account termination and may constitute fraud.
You are solely responsible for safeguarding your login credentials. You must notify us immediately at info@lionsgaterealty.ca if you suspect unauthorized access. Lions Gate Realty is not liable for any loss resulting from unauthorized use of your account.
Each individual may hold only one Guest account. Creating duplicate accounts to circumvent a suspension or ban is a violation of these Terms and grounds for permanent removal from the platform.
By creating an account, you consent to receive transactional emails (booking confirmations, receipts, security alerts) and service communications from Lions Gate Realty. You may opt out of non-essential marketing communications at any time.
By clicking "I Agree", "Create Account", "Book & Pay", or any similar button or checkbox, you are entering into a binding legal agreement electronically. This constitutes a valid electronic signature under British Columbia's Electronic Transactions Act [SBC 2001] and carries the same legal weight as a handwritten signature. You agree that electronic records and communications satisfy any legal writing requirement.
When your payment is successfully processed, a binding reservation is created between you (the Guest) and the Host. You will receive a confirmation email with your booking reference number. Lions Gate Realty is not a party to this reservation.
You may not sub-let, re-list, resell, or transfer your booking to any third party without the express written consent of the Host and Lions Gate Realty. Doing so may result in immediate cancellation without refund and account termination.
Hosts are required to disclose the existence of all surveillance cameras or recording devices on the property in their listing. Lions Gate Realty prohibits hidden cameras in any indoor area, especially bedrooms and bathrooms. You should review a listing's disclosures before booking. Lions Gate Realty is not responsible for any undisclosed surveillance by a Host.
Lions Gate Realty strongly recommends that all Guests purchase comprehensive travel insurance covering trip cancellation, medical emergencies, personal liability, and accidental property damage before making a booking. Lions Gate Realty provides no insurance of any kind.
Hosts are solely and entirely responsible for ensuring that all listing content — including title, description, photos, amenities, pricing, guest capacity, minimum stay, and availability calendar — is accurate, current, truthful, and not misleading. Misrepresentation of any listing is grounds for immediate removal and may constitute fraud.
By creating a listing, you represent and warrant that you have the full legal right to rent the property for short-term use, including: ownership or landlord permission, compliance with strata or condo corporation rules, compliance with all applicable municipal bylaws and provincial legislation — including British Columbia's Short-Term Rental Accommodations Act — and any other applicable law. Lions Gate Realty bears no responsibility for a Host's failure to have the legal right to list.
Hosts must maintain property and liability insurance that explicitly and specifically covers short-term rental activity. Many standard homeowner and condo policies exclude short-term rentals. Failure to hold appropriate insurance is a breach of these Terms. Lions Gate Realty accepts absolutely no liability arising from a Host's failure to maintain adequate insurance.
Hosts are solely responsible for determining, collecting, remitting, and reporting all applicable taxes, including GST/HST, BC PST, Municipal Regional District Tax (MRDT), and any other applicable accommodation or income taxes. Lions Gate Realty does not collect or remit taxes on behalf of Hosts and makes no representation regarding Host tax obligations.
Hosts are independent contractors, not employees, agents, or partners of Lions Gate Realty. Nothing in these Terms creates any employment, agency, franchise, joint venture, or partnership relationship between a Host and Lions Gate Realty.
Payouts are processed via Stripe Connect to the bank account provided during onboarding. Payouts are typically initiated 2–7 business days after Guest check-in, subject to Stripe's payout schedule and any fraud holds. Lions Gate Realty is not liable for payout delays caused by Stripe, banking institutions, or incorrect banking details provided by the Host.
This policy applies to both Hosts (in accepting or rejecting bookings) and Guests (in their conduct toward Hosts and other users).
A guest service fee, expressed as a percentage of the booking subtotal, is added at checkout. This fee is displayed transparently on the booking summary before you confirm payment. It is non-refundable except where a cancellation occurs more than 48 hours before check-in.
Lions Gate Realty deducts a platform fee from each completed booking payout. The applicable rate is communicated to Hosts upon listing approval. Lions Gate Realty reserves the right to adjust fee rates with 30 days' written notice to affected Hosts.
All payments are processed by Stripe, Inc. By making a payment, you also agree to Stripe's Services Agreement. Lions Gate Realty does not store, transmit, or have access to your full credit card number. Stripe is PCI-DSS Level 1 certified.
Initiating a chargeback or payment dispute with your bank for a booking that was completed and not cancelled in accordance with these Terms constitutes a breach of this agreement. In the event of a fraudulent or unwarranted chargeback, Lions Gate Realty reserves the right to recover the disputed amount, associated fees, and any reasonable collection costs from you, and to suspend or terminate your account.
All prices are in Canadian Dollars (CAD) unless otherwise stated.

If a Host cancels a confirmed booking for any reason, the Guest receives a full refund of all amounts paid. Repeated Host cancellations may result in listing suspension or permanent removal from the platform.
Lions Gate Realty may, entirely at its discretion, grant exceptions to the cancellation policy in cases of documented emergencies such as: verified natural disasters, government-declared states of emergency, or serious illness preventing travel (with supporting medical documentation). Our determination is final. We are under no obligation to grant any exception.
Approved refunds are credited to the original payment method. Processing time is 5–7 business days from approval, subject to your card issuer's timeline. Lions Gate Realty is not responsible for delays caused by banks or card issuers.
Before initiating any chargeback or payment dispute, you agree to contact Lions Gate Realty at info@lionsgaterealty.ca to seek resolution. Unilateral chargebacks in violation of the cancellation policy are a breach of these Terms.
Unlike some other platforms, Lions Gate Realty does not offer, provide, or administer any damage protection program, host guarantee, guest protection program, or insurance product of any kind.
Property damage claims are a matter exclusively between the Guest and the Host. Lions Gate Realty has no obligation to mediate, arbitrate, or fund any damage claim. Both Hosts and Guests are responsible for maintaining their own appropriate insurance coverage.
If a Host claims damage caused by a Guest, the Host must raise that claim directly with the Guest. If a Guest believes a property was misrepresented or unsafe, the Guest must raise that with the Host. Lions Gate Realty may, entirely at its discretion, attempt to facilitate communication between the parties, but bears no financial responsibility and makes no guarantee of resolution.
You agree not to use the platform to:
Violations may result in immediate account suspension or permanent termination, cancellation of active bookings without refund, and referral to law enforcement where applicable.
All platform content created by Lions Gate Realty — including the website design, interface, text, graphics, logos, software, and compiled listing data — is the intellectual property of Lions Gate Realty and is protected by Canadian copyright law. You may not copy, reproduce, republish, distribute, or create derivative works from our content without written permission.
When you submit content to the platform — including listing descriptions, photos, videos, reviews, and messages — you retain ownership of that content but grant Lions Gate Realty a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to use, reproduce, modify, display, distribute, and promote that content in connection with operating and marketing the platform, including on social media and in advertising materials.
By submitting content, you represent that: (a) you own it or have the right to grant the above licence; (b) it does not infringe any third party's intellectual property or privacy rights; (c) it is accurate and not misleading; and (d) it does not violate these Terms or any applicable law.
Lions Gate Realty reserves the right to remove any user-submitted content at any time, for any reason, without notice.
Any feedback, suggestions, or ideas you provide about the platform may be used by Lions Gate Realty freely and without compensation or attribution to you.
Only Guests who have completed a verified, paid booking may leave a review for a Host or property. Only Hosts who have hosted a completed booking may leave a review for a Guest.
Reviews must be honest, first-hand, and relevant to the actual stay. Reviews must not contain: defamatory statements, personal attacks, discriminatory language, private personal information, commercial solicitation, or content unrelated to the booking experience.
Lions Gate Realty does not verify the accuracy of reviews and is not responsible for their content. We reserve the right to remove reviews that violate these standards but have no obligation to do so. Lions Gate Realty is not liable for any loss or damage arising from reliance on a review.
Hosts may not offer incentives (discounts, refunds, gifts) in exchange for positive reviews. Guests may not threaten negative reviews to extract refunds or concessions. Both constitute manipulation and are grounds for account termination.
Lions Gate Realty provides the platform "AS IS" and "AS AVAILABLE" without any warranty of any kind, express, implied, or statutory, including but not limited to: warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy of content, or uninterrupted, error-free operation.
We do not warrant that: (a) the platform will be available at all times; (b) any listing information is accurate, complete, or current; (c) any Host or Guest is who they claim to be; (d) any property is safe, legal to rent, or fit for purpose; or (e) any review is genuine or accurate.
Lions Gate Realty expressly and unconditionally disclaims all responsibility and liability for:
(a) any damage to, or destruction of, personal or real property occurring at a listed property;
(b) any personal injury, illness, disability, or death of any person at a listed property;
(c) theft, loss, or disappearance of any belongings during a stay;
(d) any emotional distress, mental suffering, or psychological harm;
(e) any financial loss arising from a cancelled, misrepresented, or fraudulent listing;
regardless of cause, including but not limited to: structural defects, fire, flood, gas leak, electrical fault, unsafe conditions, criminal acts by third parties, or the negligence of any Host, Guest, or other person.
Lions Gate Realty is not responsible for and expressly disclaims all liability for the acts, omissions, or conduct of any Host or Guest, including misrepresentation of listings, failure to maintain property standards, property damage, harassment, discrimination, or any illegal activity.
Lions Gate Realty is not liable for any loss or damage caused by platform downtime, technical errors, data loss, security breaches outside our reasonable control, or the acts of third-party service providers including Stripe, Hostinger, or email delivery services.
The existence of more than one claim will not increase the above liability cap. You agree that the liability limitations in this section are a fundamental element of the agreement between you and Lions Gate Realty, and that Lions Gate Realty would not provide this platform without them.
Lions Gate Realty reserves the right to assume exclusive control of any matter subject to indemnification by you, at your expense.
Lions Gate Realty is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including: acts of God, natural disasters, pandemics, government orders, war, civil unrest, strikes, power failures, internet outages, or third-party service failures. We will make reasonable efforts to resume normal operations as soon as practicable.
Lions Gate Realty reserves the right, at any time and without notice, to: modify, suspend, or permanently discontinue any part or all of the platform; change pricing or fees (with 30 days' notice for existing Hosts); remove any listing; and cancel any booking where we have reason to believe it violates these Terms or applicable law.
We may suspend or permanently terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or harmful conduct, or for any other reason at our sole discretion. Active bookings may be cancelled without refund in cases of clear Terms violations.
Lions Gate Realty reserves the right to investigate suspected violations and cooperate with law enforcement authorities. We may access, preserve, and disclose account information and content if required by law or if we believe in good faith that doing so is necessary to investigate or prevent harm.
The platform may contain links to third-party websites. Lions Gate Realty is not responsible for the content, privacy practices, or conduct of any third-party website and does not endorse them. Visiting third-party sites is at your own risk.
Before initiating any legal proceeding against Lions Gate Realty, you agree to contact us at info@lionsgaterealty.ca and attempt to resolve the dispute informally. We will make good-faith efforts to resolve your concern within 30 days of receiving it.
Lions Gate Realty has no obligation to mediate disputes between Guests and Hosts. We may, at our sole discretion, attempt to facilitate communication between parties, but our involvement or any outcome we facilitate does not constitute legal advice, a binding determination, or financial liability on the part of Lions Gate Realty.
These Terms are governed exclusively by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of British Columbia, Canada. You irrevocably submit to that jurisdiction and waive any objection to it.
Any claim arising from your use of the platform must be commenced within one (1) year of the date you knew or reasonably ought to have known of the facts giving rise to the claim. Claims not commenced within this period are permanently barred, to the maximum extent permitted by law.
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Lions Gate Realty regarding your use of the platform and supersede all prior agreements, representations, or understandings relating to the same subject matter.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Lions Gate Realty's failure to enforce any right or provision of these Terms on any occasion does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Lions Gate Realty to be effective.
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. Lions Gate Realty may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets.
These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version prevails.
We may update these Terms at any time. For material changes, we will notify registered users by email at least 14 days before the changes take effect, with the new effective date shown at the top. Continued use of the platform after that date constitutes binding acceptance of the updated Terms.
