Rental Listing Terms & Conditions

These Terms & Conditions ("Terms") govern the submission of rental listings on lionsgaterealty.ca and the rental placement services provided by Lions Gate Realty ("we," "us," or "Agent"). By submitting a rental listing, you ("Owner" or "Landlord") agree to these Terms.

1. Listing Submission

Submitting a listing is free of charge. All submissions are reviewed and must be approved by Lions Gate Realty before appearing publicly. We reserve the right to reject, edit, or remove any listing at our sole discretion, without notice.

By submitting a listing, you confirm that:

• You are the registered owner or authorized representative of the property.
• All information provided is accurate and complete.
• The rental listing complies with BC's Residential Tenancy Act and all applicable human rights legislation.
• You will not discriminate against prospective tenants on any protected grounds under the BC Human Rights Code.

2. Referral Fee

The referral fee is due within 7 days of the tenancy agreement being signed. No fee is payable if a tenant is not successfully placed. Listing your property does not guarantee placement.

3. Identity Verification (FINTRAC)

As a licensed real estate brokerage, Lions Gate Realty is required by federal law under the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (FINTRAC) to verify the identity of all clients before providing real estate services.

Prior to your listing being activated and any tenants being introduced, you must provide:

• A copy of one valid, government-issued photo identification (e.g. driver's licence, passport, or BC Services Card).
• If the owner is a corporation or legal entity, additional documentation including articles of incorporation and identification of the authorized representative will be required.

Your listing will not be actively marketed until identity verification is complete. Submission of a listing online does not waive this requirement.

4. Listing Agreement & Representation

The online submission of your listing is a preliminary step only. It does not constitute a binding representation agreement. You will be contacted by a Lions Gate Realty representative to complete the required documentation before your listing is published or any tenants are introduced.

By proceeding, you acknowledge that:

• You understand a signed Listing Agreement is required before active representation begins.
• You will cooperate with identity verification requirements under FINTRAC.
• You have the legal authority to rent the property (as owner or authorized representative).

5. Required BC Government Forms

Under BC's Residential Tenancy Act, landlords are required to use standard government forms. The following forms are mandatory and available free of charge from the BC Residential Tenancy Branch:

• RTB-1 — Residential Tenancy Agreement
  The legally required lease agreement between landlord and tenant. Must be used for all residential tenancies in BC. Both parties must sign before the tenancy begins and each must receive a copy within 21 days of signing.

• RTB-27 — Tenant's Notice to End Tenancy
  Used by tenants when they wish to give notice to end their tenancy. Landlords should be familiar with this form and provide it to tenants upon request.

• Condition Inspection Report
  Required by law at both move-in and move-out. Documents the condition of the rental unit. Protects both landlord and tenant in any dispute over damage or security deposit deductions. Both parties must sign and receive a copy.

8. Scope of Service

Lions Gate Realty provides a rental listing platform and may assist in marketing your property and introducing prospective tenants. We do not act as a property manager, guarantor, or party to any tenancy agreement. The tenancy agreement is solely between the Owner and the Tenant.

9. No Guarantee

We do not guarantee that your listing will receive inquiries, that a tenant will be found within any specific timeframe, or that any tenant introduced will fulfil their tenancy obligations.

10. Privacy

Contact information submitted with your listing will be used to communicate with you regarding your listing and, once approved, may be displayed to prospective renters browsing our platform. We do not sell your information to third parties.

11. Removal of Listings

You may request removal of your listing at any time by contacting us at info@lionsgaterealty.ca. We will remove the listing within 2 business days of your request.

12. Limitation of Liability

Lions Gate Realty is not liable for any loss, damage, or dispute arising between the Owner and any tenant, prospective tenant, or third party. Our liability is limited to the amount of any referral fee paid.

13. Governing Law

These Terms are governed by the laws of British Columbia, Canada. Any disputes shall be resolved in the courts of British Columbia.

14. Changes to These Terms

We may update these Terms at any time. Continued use of the listing platform after changes constitutes acceptance of the revised Terms.
